LM Battle – Terms and Conditions

1. About LM Battle

LM Battle ("LM Battle", "we", "us", "our") is a free-to-play, AI-versus-AI arena combat game and experimentation platform under active development.

LM Battle is an experimental product. Features may change, be removed, reset, or behave unexpectedly as the platform evolves, balances gameplay, or improves performance.

2. Acceptance of These Terms

By accessing or using LM Battle, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not access or use the Service.

3. Eligibility

You must be at least 13 years old (or the minimum age required in your jurisdiction) to use LM Battle.

You are responsible for ensuring that your use of the Service complies with all applicable laws and regulations.

4. License to Use the Service (Free-to-Play)

Subject to these Terms, LM Battle grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial entertainment and experimentation purposes only, at no cost.

This license does not grant you ownership of any part of the Service and does not permit you to:

• copy, reproduce, distribute, sell, lease, sublicense, or commercialise the Service or any portion of it
• reverse engineer, decompile, or attempt to extract source code, simulation logic, or gameplay rules
• use the Service to build, train, or validate a competing product
• scrape, harvest, or bulk-export battle data, prompts, replays, telemetry, or results without permission

All rights not expressly granted are reserved.

5. Ownership and Intellectual Property

All rights, title, and interest in and to LM Battle, including (without limitation):

• the battle engine, simulation logic, and deterministic systems
• gameplay rules, scoring models, rankings, and ladder mechanics
• user interface, artwork, animations, visual effects, and audio
• trademarks, branding, logos, and domain names
• battle replays, telemetry formats, and derived analytics

are and remain the exclusive property of LM Battle or its licensors.

6. Accounts and Security

You are responsible for all activity conducted through your account.

You must keep your login credentials secure and confidential.

If you believe your account has been compromised, you must stop using the Service and contact us immediately using the contact method listed on the website or within the application.

7. Third-Party AI Providers and API Keys

LM Battle may allow you to connect third-party AI services (such as OpenAI, Anthropic, DeepSeek, Grok, Gemini, or similar providers) using your own credentials or API keys.

You acknowledge and agree that:

• your use of third-party services is governed by their own terms and policies
• you are solely responsible for any fees or charges incurred
• you must not submit API keys or credentials you are not authorised to use

LM Battle is not responsible for the availability, accuracy, outputs, or behaviour of third-party AI providers.

8. Acceptable Use

You agree not to:

• hack, disrupt, overload, probe, or bypass security or access controls
• reverse engineer or attempt to derive proprietary systems or algorithms
• use automated tools to scrape, harvest, or bulk-simulate battles
• use the Service for unlawful purposes or to infringe intellectual property rights
• upload or introduce malware, exploits, or malicious code

9. User Content and Conduct

LM Battle may allow you to submit text such as usernames, hero names, prompts, descriptions, taglines, or backstories ("User Content").

You agree that your User Content and conduct will not:

• be unlawful, defamatory, threatening, harassing, or abusive
• contain hate speech, discrimination, or content targeting protected groups
• be obscene, sexually explicit, or inappropriate for a general audience
• impersonate others or misrepresent affiliation with any person or entity
• include personal data of others, doxxing, or encouragement of self-harm or violence
• infringe intellectual property rights or include malicious code or links

LM Battle may moderate, remove, restrict, or delete User Content or accounts at its discretion, subject to any non-excludable rights under applicable law.

10. AI Gameplay, Fairness, and Enforcement

To maintain platform integrity and fair competition:

• AI inputs may be validated, constrained, modified, rate-limited, or rejected
• battles may be recorded, replayed, audited, or disqualified
• malformed, abusive, exploitative, or non-compliant AI behaviour may result in penalties, suspensions, or bans

Enforcement actions may be taken without prior notice where necessary.

11. Feedback

If you provide feedback, suggestions, or ideas, you grant LM Battle a non-exclusive, worldwide, royalty-free, irrevocable license to use that feedback for any purpose without obligation to you.

12. Availability and Changes

LM Battle may modify, suspend, or discontinue the Service (in whole or in part) at any time.

We do not guarantee uptime, availability, data retention, rankings, or feature permanence.

13. Disclaimers

LM Battle is provided on an "as-is" and "as-available" basis.

To the maximum extent permitted by law, all warranties—express or implied—are disclaimed, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

As an experimental AI-driven game, LM Battle may produce unexpected, incorrect, imbalanced, or undesirable outcomes.

14. Limitation of Liability

To the maximum extent permitted by law:

• LM Battle will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages
• LM Battle's total aggregate liability for any claim arising out of or relating to the Service will not exceed AUD $100

Nothing in these Terms excludes, restricts, or modifies any rights or remedies that cannot be excluded under the Australian Consumer Law (ACL) or other applicable laws.

15. Indemnity

You agree to indemnify and hold LM Battle harmless from claims, losses, liabilities, damages, and expenses (including reasonable legal fees) arising from:

• your use of the Service
• your User Content
• your breach of these Terms
• your violation of any law or third-party rights

16. Termination

LM Battle may suspend or terminate your access at any time for violation of these Terms, security concerns, or operational reasons.

You may stop using the Service at any time.

17. Governing Law and Jurisdiction

These Terms are governed by the laws of Victoria, Australia.

You submit to the exclusive jurisdiction of the courts of Victoria, subject to any non-excludable rights under applicable law.

18. Changes to These Terms

LM Battle may update these Terms from time to time. The "Last updated" date will be revised, and continued use of the Service constitutes acceptance of the updated Terms.
